DMCA Takedown Procedure

ReUpload (operated by Noah Johnston, dba “ReUpload,” a sole proprietor based in Wisconsin, United States) respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe content generated through our Service infringes your copyright, follow the procedure below.

How to submit a takedown notice

Email noahjj1350@gmail.com with the subject line “DMCA Takedown Notice”. To be valid under 17 U.S.C. § 512(c)(3), your notice must include all of the following:

1. Your physical or electronic signature (typed full name is acceptable for the electronic version).
2. Identification of the copyrighted work you claim has been infringed (title, ownership proof, registration number if available).
3. Identification of the infringing material — the specific URL(s) on reupload.co or generated clip URLs hosted on our infrastructure.
4. Your contact information — full name, address, phone, email.
5. A statement that you have a good-faith belief the use is not authorized by the copyright owner, agent, or law.
6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act on the owner's behalf.

What happens after we receive a notice

• We will review and acknowledge the notice within 2 business days.
• If the notice is valid, we will remove or disable access to the infringing material and notify the user who generated it.
• Repeat infringers have their accounts terminated per our repeat-infringer policy below and our Acceptable Use Policy.

Repeat-infringer policy

Consistent with 17 U.S.C. § 512(i) and recent guidance from the U.S. Court of Appeals in Cox v. Sony (March 2026), ReUpload reasonably implements a policy for terminating accounts of repeat infringers. Specifically:

• Each valid DMCA takedown received against an account is logged as a strike against that account, with the date, source URL, and complainant.
• On the second valid strike, the account receives a written warning and is required to acknowledge the AUP before continuing to use the Service.
• On the third valid strike, or any single egregious infringement (e.g. wholesale re-upload of a copyrighted work, willful evasion), the account is terminated and the user is barred from re-registering.
• Strikes may be contested by counter-notice (see below). A successful counter-notice or court ruling removes the corresponding strike.
• Termination decisions are reviewed and documented by Noah Johnston before being issued.

Counter-notice

If you believe your content was removed in error, you may submit a counter-notice to noahjj1350@gmail.com with the subject “DMCA Counter-Notice”including the elements specified in 17 U.S.C. § 512(g)(3). If the original claimant doesn't file a court action within 10–14 business days, we will restore the content.

Designated agent

ReUpload's DMCA designated agent is (or will be) registered with the U.S. Copyright Office. See the public directory at dmca.copyright.gov/osp/ ↗. For the current agent record, email noahjj1350@gmail.com.

Counter-notification (17 U.S.C. § 512(g))

If your content was removed due to a DMCA notice and you believe the removal was a mistake or misidentification, you may send our designated agent a written counter-notification containing: (1) your physical or electronic signature; (2) identification of the removed material and its location before removal; (3) a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; (4) your name, address, and phone number; and (5) a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, any judicial district in which ReUpload may be found) and that you will accept service of process from the person who filed the original notice.

On receiving a valid counter-notification we will forward it to the original claimant and, unless they notify us within 10–14 business days that they have filed a court action, we may restore the removed material.
